1. Who can use Vital

Vital is built for registered, enrolled and student nurses in Hong Kong, and for anyone tracking continuing nursing education (CNE).

• You must be at least 13 years old to hold an account.
• Give accurate registration details. Cycle dates, point targets and renewal reminders are calculated from what you enter — wrong input produces wrong reminders.
• Your account is personal. Do not share your password, and do not let another person log CNE under your account.
• You are responsible for activity under your account. Tell us promptly if you suspect unauthorised access.

2. What Vital is — and what it is not

Vital is a personal record-keeping and course-discovery tool. Read this section carefully; it is the one that matters most.

• Vital is NOT affiliated with, endorsed by, or acting on behalf of the Nursing Council of Hong Kong (NCHK) or any other registration authority. Logging a course in Vital is not a submission to NCHK.
• Nothing in Vital is legal, regulatory, medical or professional advice. Cycle dates, point totals, exports and reminders are calculated aids — they are not a determination that you are, or are not, compliant.
• Course listings are compiled from publicly available provider information and from submissions by other users. Dates, points, accreditation status, fees and remaining places can change or be wrong. Verify with the provider, and with NCHK, before relying on them.
• You remain solely responsible for meeting your own CNE requirements, for the accuracy of anything you submit to NCHK, and for keeping your own copies of your certificates.

We publish the regulatory figures Vital uses — required points, cycle length, retention periods — together with their source and the date we last checked them. If you find something out of date, please tell us and we will correct it.

3. Your records and your content

Your CNE records, certificate images, notes and course submissions are yours. You keep ownership of them.

• You grant us a limited licence to store, process, back up and display your content for the sole purpose of operating Vital for you. We do not sell it, and we do not use it to train AI models.
• When you submit or correct a course for the shared catalogue, that course information becomes part of the public catalogue and may be shown to other users. You are credited according to the visibility setting you chose — anonymous by default.
• Do not upload content you have no right to share, anything containing another person's personal data or any patient information, or anything unlawful.
• We may moderate, edit or remove community submissions, including for accuracy, and may decline or reverse scan credits awarded for submissions that turn out to be duplicated, fabricated or automated.

4. AI certificate scanning

The scan feature sends the certificate image or PDF you choose to our AI provider so it can read the course title, date and points.

• Extracted fields are SUGGESTIONS. They are shown to you for review and are saved only when you confirm them. AI extraction can be wrong — including confidently wrong.
• You are responsible for checking every field before saving, and for the accuracy of the record that results.
• Scanning is metered by credits: a free allowance each year, plus credits you can earn by contributing to the catalogue, or unlimited scanning with Vital Pro.
• Credits are a usage allowance, not currency. They have no cash value, cannot be bought, transferred, sold or refunded, and unused credits expire with the period they were granted for. We may adjust allowances and anti-abuse limits; a material reduction will be announced in-app first.

5. Vital Pro subscriptions

Vital's core is free. Vital Pro is an optional auto-renewing subscription, sold and billed through the App Store.

• Pro includes exactly three things: the one-tap NCHK audit pack, unlimited AI certificate scanning, and custom reminder lead days (0–14). Everything else — unlimited records and certificate storage, NCHK Annex A and B exports including archived cycles, dual-licence cycle tracking, renewal reminders, course search, the CNE information centre and regulatory alerts — is free and stays free.
• Price and duration are shown in the app, in your local currency, before you buy. Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
• Manage or cancel in your Apple Account subscription settings. Cancelling stops the next renewal; it does not shorten or refund the period you have already paid for.
• Purchases, billing, refunds and price-change notices are handled by Apple, not by us. We cannot issue App Store refunds — request one from Apple at reportaproblem.apple.com.
• If we change Pro's price or what it includes, Apple will ask you to confirm before charging any increase, and you may cancel instead.
• IF YOUR SUBSCRIPTION LAPSES, you keep full access to your own records, certificates and NCHK exports. We do not lock your compliance evidence behind the paywall — only the three Pro features above stop working.
• No free trial or introductory offer is currently offered. If one is introduced, its length and the price that applies afterwards will be disclosed in the app before purchase.

6. Acceptable use

You agree not to:

• use Vital to falsify a CNE record, or to misrepresent your registration, qualifications or attendance;
• scrape, bulk-download or systematically extract the course catalogue, or access the service by automated means beyond normal use of the app;
• circumvent, disable or probe usage limits, credit allowances, entitlement checks or any security control;
• reverse engineer, decompile or attempt to derive source code, except to the extent this restriction is prohibited by law;
• resell, sublicense or provide Vital as a service to others, or share a paid entitlement across accounts;
• upload malware, attempt to reach another user's data, or interfere with the operation of the service;
• impersonate another person, or submit community content you know to be false.

We may suspend or terminate access for a serious or repeated breach — see section 8.

7. Availability and changes to the service

We work to keep Vital available, but we do not guarantee uninterrupted or error-free service. Features may change, and we may add, modify or discontinue functionality. Where a change materially reduces something you have paid for, we will say so in the app before it takes effect. Some features require an internet connection, and some depend on third parties (section 10). Push reminders are delivered on a best-effort basis by Apple's notification service and must not be your only safeguard against a renewal deadline.

8. Suspension, termination and deletion

• You may stop using Vital at any time, and delete your account from Profile → Delete account. Deletion is permanent and irreversible — the Privacy Policy sets out exactly what is removed.
• Deleting your account does NOT cancel an App Store subscription. Cancel it in your Apple Account settings, or it will keep renewing.
• We may suspend or terminate an account that breaches these Terms, that we are legally required to act on, or that presents a security risk. Where it is practical and lawful to do so, we will give notice and a chance to put things right.
• Terms that by their nature should outlast the account — the licence already granted for catalogue content you published, the disclaimers, the liability limits and the governing law — survive termination.

9. Intellectual property and your licence

Vital, its name, logo, interface, written content and software are ours. We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the app on Apple-branded devices you own or control, or through the web app, in accordance with these Terms and the Apple Media Services Usage Rules. No other rights are granted.

Third-party names — NCHK, course providers, Apple — are used descriptively to identify what they refer to, and imply no endorsement of Vital by them.

10. Services we rely on

Vital runs on infrastructure we do not control. These providers process data on our behalf as service providers:

• Apple — App Store distribution, Sign in with Apple, in-app purchases, and push notification delivery.
• Supabase — managed Postgres, Storage, Auth and Edge Functions.
• RevenueCat — subscription and entitlement state.
• Google Cloud (Vertex AI) — certificate text extraction for the scan feature.

What each one receives is described in the Privacy Policy. We do not use third-party analytics, advertising or attribution SDKs.

11. Disclaimers

To the fullest extent permitted by law, Vital is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that course information, calculated cycle dates, point totals, exports, AI-extracted fields or reminders are accurate, complete, current or delivered.

Nothing in these Terms excludes or limits anything that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, liability for fraud or fraudulent misrepresentation, or your rights under Hong Kong consumer protection legislation.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, special or consequential loss, loss of profit or business, or loss of data other than data lost through our own failure to keep the backups we say we keep. In particular, we are not liable for the consequences of a missed CNE requirement, a lapsed or refused registration, a rejected NCHK submission, or reliance on course information or a calculated date — responsibility for meeting your own CNE requirements is yours (section 2).

Our total aggregate liability for all claims arising out of or relating to Vital is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, and (b) HK$500. This section is subject to the final paragraph of section 11.

13. Additional terms required by Apple

These terms apply to the Vital iOS app obtained from the App Store, and take precedence over anything inconsistent elsewhere in these Terms:

• This agreement is between you and Vital only, not with Apple. Vital, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide any maintenance or support services for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
• Vital, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Vital, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the app or your use of it infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you. Your use of the app must also comply with the Usage Rules in the Apple Media Services Terms and Conditions.

14. Changes to these Terms

We may update these Terms. Material changes will be announced in the app and, where we hold an email address for you, by email, before they take effect. Non-material clarifications may be made with the effective date updated. Continuing to use Vital after a change takes effect means you accept the updated Terms; if you do not accept them, stop using Vital and delete your account. The current version is always at this URL.

15. Governing law and severability

These Terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law where you live. If any provision is held unenforceable, the remaining provisions stay in full force.
